After consulting with legal counsel, I vetoed ONCA 26-64, sponsored by Congressman Eli Potts. The legislation attempts to exercise powers that are constitutionally reserved to the Executive Branch and improperly interferes with the authority and operations of an Executive Branch Board. These provisions are inconsistent with the Separation of Powers and Code of Ethics established in the Osage Nation Constitution and previously addressed by our Osage Nation Supreme Court.
As Principal Chief, I have a duty to uphold, defend, and faithfully execute the Osage Nation Constitution. Based on that responsibility, and after careful legal review, I determined that ONCA 26-64 is unconstitutional and could not allow it to become law.
I support legislation that helps provide our students with the tools and resources they need to succeed in their educational journeys. Programs such as the Osage Nation Financial Assistance Services for School Clothing, Supplies, and Technology Program provide eligible Osage students nationwide with $250 to help offset the costs of school essentials. In addition, our Osage Nation Education Department administers multiple programs that expand opportunities for our students and families. All of these programs operate in accordance with the Osage Nation Constitution.
I encourage members of Congress to ensure that every piece of legislation they consider is consistent with the Osage Nation Constitution. Respecting and adhering to our Constitution is a shared responsibility of every Branch of government. It is essential to preserving the separation of powers, maintaining accountability, and ensuring that our government operates as intended for the benefit of the Osage people.
Supporting our students and investing in their future can and should be accomplished within the framework of our Constitution. By upholding that framework, we strengthen both our government and our ability to serve the Osage people.
